Objective: 

  

Objective of the Techno-Para-Legal services is to enable and empower organisations to interact with Courts, Law Enforcement Agencies, Government departments and Regulators on technological matters, in accordance with the Indian Laws. 

  

Existing Challenges: 

  

• There is a clear dependency of organisations on the digital world. Thus, proof of offence as well as innocence exist in the digital world.  

• Formal interaction with the Law Enforcement Agencies, Courts, Government Bodies/ authorities and Regulators is an unavoidable reality. 

• Most training are aligned with the US Laws. The Indian Evidence act as well as orders of Indian Courts are not generally covered well.

• There is limited knowledge with IT/ IT Security professionals about the way law really works on ground. 

• Similarly, there is limited knowledge with advocates about the in-depth understanding of technology. 

• This gap may adversely impact a case.   

  

What will Techno-Para-Legal services provide? 

 
 

Pre-Incident Services 

  

All organisations should be prepared to interact with LEAs, Courts, Government and Regulators for compliance and offence management. It means that people, process, devices and networks should be hygienically and cyber-forensically clean to extract relevant information and evidences. Our services for getting your organisation ready for such eventuality includes:  

• Readiness Checks: Check Cyber system readiness for acquiring credible digital evidence in accordance with the principals of forensics and Indian laws.  

 

• Joint Awareness Session: There is need to close perception gaps between management team, legal team, CIO team and CISO team. We conduct a joint session of these teams' covering awareness and then simulating situations to improve the team work for handling cyber-incident which may escalate to courts or regulators. (Duration 4 hrs.)

• DEFR Training: Cyber Evidences are very volatile and can be easily manipulated to protect or implicate  anyone.  Therefore,  courts are very careful about digital evidences. It, therefore, requires that only trained persons with good tools, who should undertake the activity of cyber evidence collection. Such person has to an internal employee appropriately trained and empowered.  We conduct training for IT and IT Security team to undertake the function of Digital Evidence First Responder (DEFR). (It is a short 8 hrs training.)

Post-Incident Services 

  

• Once an incident has taken place and it is considered serious enough from the business perspective, Organisation may not be sure, if that incident will be taken up as a criminal case or civil suit or both? Are the evidences are strong enough to achieve the legal goal? Should the regulator be informed? should CERT-In be informed? Evaluation of strength of cyber evidences and case is complex and best legal approach is not easy. We provide the support and consultancy to help an organisation to take the most appropriate decision.

• It is rarely single evidence which prove the issue. Normally it is series of them, spread over complete network and some time in open source. For any cyber investigation, it is important to identify and collect all the evidences and to prove the offence or innocence. We have a team, who works not only with private sector but also supported the government entities like Income Tax department and also courts in important cases. Our services will help the organisations in identifying the relevant electronic evidences, acquire (Capture) the evidence, undertake relevant analysis, support the decision making, prepare appropriate file for the advocate to represent the organisation effectively.

• It is not always the case where your organisation is a compliant. Some time you may have to respond to the inquiry by an LEA or the concerned regulator or a government entity or summon/warrant issued by the court. Improper, inaccurate or incomplete reply can have serious consequences. We assist you in doing ground work for your lawyer to give appropriate response. We do not replace the lawyers but support them. Of course, if you need an advocate to represent you in Supreme Court or in Delhi/Mumbai High Court we can help you. In near future we will extend the advocates availability for other High Court too.   

• There are occasions when an expert witness for Technology matters is necessary to validate the report or technological complexities. Please approach us, to provide you effective expert witness who can assist the court in understanding the complexity of technology so that the court / regulator can arrive at informed decision.  

• We meet the stringent requirement of Indian laws, especially Indian Evidence Act and the Information Technology Act in all stages of cyber evidences - Identification -> Acquisition -> Indexing -> Working Colons -> Search and Analysis of collected evidence -> Report preparation -> Presentation of report in the court.
